Context:

Project Context and Scope

IOM is currently implementing the Joint Recovery Action Plan (JRAP), a collaborative initiative by United Nations agencies in Nepal aimed at supporting the long-term recovery and reconstruction of communities affected by the 2023 Jajarkot earthquake in Karnali Province. IOM Nepal is specifically assisting with the shelter component of JRAP. This project will provide communities with access to shelter assistance packages and socio-technical support for households as they rebuild their homes. By empowering affected and vulnerable populations, the project aims to transform them into agents of recovery, facilitating not only the reconstruction of homes and communities but also the reduction of future risks through the development of green technologies, particularly through the establishment of local enterprises based on stone masonry and Compressed stabilized earth block (CSEB).

To ensure the sustainability of these construction enterprises, local policy interventions will be essential. Moving forward, IOM is focused on integrating sustainable actions through discussions on existing capacities, identifying gaps, and exploring future possibilities for the sustainability of local enterprises. This includes developing operational guidelines for enterprises at the local level. The consultant will play a key role in contributing to the following project output under JRAP project.

Core functions / Responsibilities:

Tasks to be performed under this contract;

The consultant will deliver the following task with a maximum of 50 working days.

  • Literature review: Review of legislative documents at the federal, provincial and local levels related to construction enterprises.
  • Consultations: Conduct individual and group consultations to enhance understanding of existing policy provisions and gaps and develop a common understanding on how a construction enterprises operation guideline at the local level should be.  Consultations will be held with government agencies at the local, provincial and federal level as highlighted in the section “Nature of the consultancy” of this TOR document. 
  • Advocacy workshops: Facilitate two advocacy workshops (at the district level) on the importance of developing construction enterprises operation guideline at the local level.
  • Drafting of enterprise operation guideline: Draft construction enterprises operation guideline for 13 selected local governments in a participatory manner. The guideline document should focus on product quality control, repair and maintenance, monitoring committee and their roles and responsibilities, monitoring checklist and reward and punishment provisions, among other things.  
  • Validation and endorsement workshops: Facilitate the process of formally validating and endorsing enterprises operation guideline at any two local governments.

Performance indicators for the evaluation of results:

  • Submission of inception report.
  • Facilitation in two advocacy workshops and two validation/endorsement workshops and submission of power point presentations of these two types of events.
  • Submission of final versions of 13 local level construction enterprises operation guidelines (incorporating feedback from IOM and concerned local government)

Required Qualifications and Experience

Education/ Experience/Skills

  • MPhil or Doctorate degree in Business Management (with an enterprise specialization), Business Administration, or a master’s degree in business management (with an enterprise specialization), Business Administration, social studies, social work, development studies, or Public Policy from an accredited institution.
  • A minimum of ten (10) years of experience collaborating with high-level government officials, ministries, and provincial and local governments in Nepal within the enterprise sector.
  • Strong understanding of local resources and enterprise development, along with in-depth knowledge of provincial and municipal government structures related to enterprise development.
  • Familiarity with enterprise policies and legal frameworks in Nepal, and their integration into the federal system.
  • Proven experience in developing enterprise policy documents, including laws, bylaws, strategies, and guidelines at local levels, with knowledge of federal and provincial legal contexts.
  • Excellent facilitation skills, with the ability to engage effectively with local stakeholders within the legal frameworks of federal and provincial ministries and other government institutions.
  • Comprehensive understanding of the roles, responsibilities, and gaps in enterprise development across governing bodies in Nepal, with strategies to prevent duplication of efforts at provincial and local levels.
  • Strong communication and collaboration skills, capable of engaging with diverse stakeholders, including government representatives and project partners.
  • Familiarity with similar project and experience of working with UN is an asset.

Languages

Fluency of English and Nepali is required (Verbal and Written). Working knowledge of any other local language is an advantage.
