Context:

Project context and Scope

Joint Recovery Action Plan (JRAP) is a joint Programme of the United Nations agencies in Nepal developed to support long term recovery and reconstruction of 2023 earthquake affected communities in Karnali Province.  The shelter component of JRAP is being supported by IOM Nepal. The shelter-related interventions planned through this project will enable communities to access shelter assistance packages and provide socio-technical support to households rebuilding their homes. The project will empower the affected and vulnerable populations to become agents of recovery in rebuilding their homes and communities and reduce future risks. The aim of the shelter-related interventions planned through this project is to support the Government of Nepal in creating an enabling environment for long term recovery and reconstruction of affected communities.

The project has the following three outputs:

Output 1.1: Affected communities have increased capacity and awareness on building back better techniques through the provision of socio-technical support.

Output 1.2: Affected communities have improved access to shelter assistance packages.

Output 1.3: An accountable, transparent and two-way communication channel on recovery and reconstruction for the affected communities is established and/ or strengthened.

Core functions / Responsibilities:

The consultant will be performing the following tasks:

A. Review of Existing Regulations and Building Code:

  • Conduct an in-depth review of current building practices and enforcement mechanisms in the targeted four municipalities.
  • Identify gaps and weaknesses in construction safety standards, existing bylaws, and the enforcement of the building code.

B. Stakeholder Consultation:

  • Facilitate at least 12 (3 consultation each in 4 local levels) consultations with municipal officials, engineers, and other relevant stakeholders.
  • Collect feedback on local challenges, potential improvements, and practical solutions through workshops with political leaders, local authorities, and engineers

C. Development of Draft Building Bylaws:

  • Draft building bylaws based on the rural context, with consideration for local construction materials, methods, and risk factors.
  • Ensure that the bylaws address critical issues including but not limited to structural integrity, fire safety, accessibility, environmental sustainability, and disaster resilience (especially for earthquakes).

D. Formulation of Building Code Implementation Regulations:

  • Develop detailed procedures for implementing the building code, including permit processes, inspection procedures, and enforcement mechanisms.
  • Establish guidelines for monitoring and evaluation of compliance at different stages of construction (e.g., design, construction, occupancy).
  • Propose penalties and incentives to encourage compliance with the regulations.

E. Finalization and Submission:

  • Refine the draft bylaws and regulations by incorporating feedback from stakeholders, gathered through 12 consultations and workshop.
  • Support to finalize bylaws and regulations at the selected four local governments.

Performance indicators for the evaluation of results:

  • Inception Report detailing the methodology, work plan, and schedule for the assignment.
  • Draft Building Bylaws and building code implementation regulations for the selected four municipalities. 
  • Finalized Building Bylaws and Regulations after integrating feedback from stakeholders.

Required Qualifications and Experience

Education/ Experience/Skills

  • Master's degree in civil engineering, urban planning, architecture, or a related field with more than 15 years of experience. 
  • Experience in developing building regulations, bylaws, or similar regulatory frameworks, preferably in rural or semi-urban contexts.
  • Experience working in Jajarkot and West Rukum, with a strong understanding of the Nepal National Building Code (NBC) and local construction practices.
  • Expertise in building safety standards, disaster risk reduction, and regulatory enforcement.
  • Proven ability to conduct stakeholder consultations and engage with local governments.
  • Drafting and report-writing skills in both English and Nepali.
  • Fluency in English and Nepali is required.

Languages

Fluency of English and Nepali is required (Verbal and Written). Working knowledge of any other local language is an advantage.
