Call for consultant for - Revision of National Minimum Standards (NMS)

and Standard Operating Procedure (SOP)

1. Background

Shakti Samuha is the world’s first organization established and run by survivors of human trafficking, as noted in the 2007 TIP Report by the USA. Founded in 1996 and officially registered in Kathmandu in 2000, Shakti Samuha has been working against human trafficking.

The National Human Trafficking and Transportation Control Act (HTTCA) 2064 and Regulations 2065 has assimilated concept of rights of survivors and provisioned establishing rehabilitation centres, managing rehabilitation fund and establishing committees at national, district and local levels to control human trafficking. To bring harmonization in the national policies with international standards related to combatting human trafficking, Nepal government has developed National Minimum Standards for the care and protection of TIP survivors (NMS), 2068 and Standard Operating Procedure (SOP) of rehabilitation centres, 2068 BS.

2. Purpose of Assignment/ Overview  

Shakti Samuha seeks a consultant who is an expert of human trafficking issues and is knowledgeable about NMS and SOP adopted by Nepal government. To gather insightful suggestions and feedback, intensive methodologies must be adopted so the consultant should be capable of collecting suggestions and feedback from the shelter network members and other CSOs and incorporate them in the final draft of the amended document.

3. Scope of work

The consultant will cover the following scope of area for the revision of NMS and SOP:

  • Submit inception proposal to Shakti Samuha after the ToR is shared.
  • Participate in initial meetings with Shakti Samuha for detail discussion about the assignment.
  • Make appropriate recommendations regarding the assignment.

A. Workshop with shelter networks members and other shelter operating organizations on NMS and SOP

  • Discuss, develop and adopt appropriate methodologies to collect feedback and suggestions that suits overall purpose of the task.
  • Identify gaps in the existing NMS and SOP documents and develop consensus on the article and provisions that are required for amendment through victim-centric approach.
  • Collect the feedback and perception of shelter operating organizations, explore the areas where revision is needed in NMS and SOP.

B. Revision of NMS and SOP

  • Coordinate and collaborate with Shelter operating organizations and concerned stakeholders.
  • Consult with Shakti Samuha during the revision process.
  • Develop initial draft of amendments of NMS and SOP after incorporating suggestions and feedbacks collected through workshop as mentioned in ‘clause 3 A’.
  • Incorporate feedbacks and suggestions provided by Ministry of Women Children and Senior Citizens (MoWCSC), Civil Society Organizations, National Committee for Controlling Human Trafficking (NCCHT) and shelter network members and develop final amended versions of NMS and SOP.

4. Expected Deliverables 

Prior to the commencement of the assignment, the following must be submitted

a. For individual

  • Proposal, financial proposal, detail timeline
  • CV with work experience, PAN

b. For company

  • Proposal, financial proposal, detail timeline
  • Legal document of company (PAN, Tax clearance, registration and citizenship)

5. Duration of the assignment 

The total durations of the assessment will be 40 days (including weekends and holidays). The assignment will start from 3rd week of January 2025 (tentatively).

6. Qualification 

  • Good understanding of issues related to Combatting Trafficking In Person (CTIP) in Nepalese context.
  • Experience and have a detail knowledge of NMS and SOP.
  • Prior experience in amendment of government legislative documents.
  • Consultant must have good coordination and communication skills.
  • Fluency in written and spoken English and Nepali languages.

7. Reporting

The reports will be developed in English 

  • Draft Report (initial draft of amendment of NMS and SOP); after completion of workshop as mentioned in ‘3 A’.
  • Final Report (initial draft of amendment of NMS and SOP): after completion of the task as mentioned in ‘3 B’
